Doug Maynard Delivers Insightful Primer at NCBA's 2024 Insurance Law Section Program

Doug Maynard, Jr., renowned for his extensive legal experience and background as a former State Farm insurance adjuster, recently took the stage at the North Carolina Bar Association's 2024 Insurance Law Section Program in Cary. His session, titled "Uninsured/Underinsured Motorist Coverage UM/UIM Primer and Perspectives," offered a comprehensive exploration of UM/UIM coverage under the Motor Vehicle Safety and Financial Responsibility Act.

Key Insights on UM/UIM Coverage

For both new and seasoned practitioners, Doug Maynard provided invaluable insights into the basic mechanics of current laws, shedding light on historical perspectives that shaped the statutes and their numerous changes since 1953. In all the legislature has amended the statute approximately thirty-five times, twenty or more changes have involved UM/UIM coverages. Many of the changes reflect the legislature’s response to decisions by the North Carolina appellate courts. The ever-changing statute creates substantial potential pitfalls for attorneys who are new or unfamiliar with the area of law.

Leveraging his unique background, Doug delved into the intricacies of UM/UIM coverage, emphasizing the evolving landscape of laws and recent legislative overhaul of the coverages in which North Carolina UM/UIM becomes excess to liability coverages and no longer subject to offset by liability coverages effective for policies issued on or after January 1, 2025. In the change the legislature increases the state’s minimum limits for liability, uninsured and underinsured motorist coverage for personal injuries to $50,000 (per person) / $100,000 (per accident). The first increase since 1999.

This act aims to modify insurance laws in North Carolina. Part XII specifically focuses on raising the minimum liability limits for state-required insurance and adjusting how the total applicable amount of underinsurance coverage is calculated.

Behind the Kellie Crabtree Award: The Client's Story in the BCBS v. N.C. Department of Insurance Legal Battle

The Greenes: Dedicated Defenders of North Carolina Citizens' Rights in the BCBS Case

Enter the Greenes, whose involvement in this case proved to be a game-changer. Paige Pahlke, the dedicated attorney who represented them, recommended the Greenes to NCAJ. The Greenes, upon hearing about the potential implications of BCBS's actions, didn't hesitate to step up to the plate.

Doug Maynard, one of the leaders of the NCAJ’s litigation efforts, emphasized the pivotal role played by the Greenes: "They knew this was wrong. It was a huge ask, though, to ask somebody to get involved as a party where they have an interest but not a tremendous interest [when compared to BCBS’s interest]... Defeating BCBS: Protecting People's Rights in North Carolina

Rather than consent to the intervention of the Greenes and the NCAJ so that all sides could be heard on this issue, BCBS objected. BCBS pulled out all stops trying to prevent or limit both the Greenes and the NCAJ involvement in the case. Even though the judge allowed both to intervene, BCBS on several occasions tried to get the Greenes dismissed and the NCAJ barred from attending depositions. Finally, after nearly year and a half of hard-fought litigation, the judge issued a Proposed for Decision soundly rejecting all of BCBS’s arguments.

Subsequently BCBS voluntarily dismissed the case. The dismissal earlier this year was a significant victory for the citizens of North Carolina, and it made a real difference that wouldn't have been possible without the Greenes' willingness to stand up for justice. Maynard expressed his gratitude, saying, "All of the citizens of North Carolina owe you a debt of gratitude."

Paige Pahlke, who represents the Greenes has been a tireless advocate for injured individuals and their families for over a decade. Her commitment to justice and her dedication to her clients have not gone unnoticed. Recognized as a "Rising Star" by North Carolina Super Lawyers magazine from 2014 to 2023 in the field of personal injury, Pahlke's exemplary work in this case reaffirms her status as a legal champion who advocates for justice for those in need.

It's also important to ask about the attorney's caseload and whether they will have the time and resources to give your case the attention it deserves.

If a firm is “profit first” due to being run like a business, then you should hire someone else. Beware of Personal Injury Lawyers Who Find You

Avoid “ambulance chasers.” A warning sign when evaluating personal injury lawyers is when they reach out to you instead of you contacting them. Shun lawyers who use aggressive solicitation tactics, like cold calling, texting, or spamming. These lawyers push and sometimes cross the line as to what State Bar ethics allow.

Some personal injury lawyers collaborate with purported "accident victim’s assistance" groups that directly approach injured individuals, offering “help” on the victim’s injury claim. They are connecting the persons with lawyers and doctors presumably for a fee. Some "accident victim’s assistance" groups even provide contracts for hiring a personal injury lawyer. Essentially, they are impermissibly acting as “runners” for the attorneys – directly soliciting clients on behalf of the attorneys.

These tactics violate State Bar ethics rules on attorney solicitation. Reputable firms do not engage in such practices. It's important to be cautious when approached by these groups, as they do not have your best interests in mind. They work with personal injury lawyers who prioritize financial gain over ethics and likely your well-being. These groups may repeatedly call you and pressure you into signing contracts or to see certain doctors in their “network.”

Remember, you have the right to choose your own legal representation and medical providers. Don't be swayed by high-pressure tactics from these groups or personal injury lawyers who are willing to work with them. Crisis Control helps residents of Forsyth and Stokes Counties facing crises with basic life needs. It provides short term help with rent/mortgage payments, utility bill assistance and food. In 2022 Crisis Control helped over 18,000 people and raised more than $2,766,000.

Like Crisis Control Ministries we assist people in crisis. As a small firm, we pack a big punch and level the playing field for those who cannot help themselves. We are a boutique law firm representing persons in personal injury and workers’ compensation claims as well as complex insurance claims against insurance companies. A 69-year-old man with a blood alcohol level four times the legal limit, drives a Ford Fusion SUV through a red light and crashes into a retired Delaware State Trooper's motorcycle, slamming into the left side of his body. At 72 years old, the retired Trooper is in North Carolina sightseeing on the Blue Ridge Parkway. He and his companion stop in Asheville for the night.

He is headed home from dinner on his motorcycle when the crash occurs, seriously injuring his leg and hip, altering his hopes for a peaceful retirement.

Just an hour earlier, the drunk driver had crashed into the side of the Holiday Inn off Tunnel Road and fled the scene with his bumper dragging.

The victim requires immediate medical attention due to the extensive injuries. Doctors perform surgery, inserting a cephalomedullary/intermediary nail to repair his hip fracture. He remains hospitalized for four days before being transferred to a rehabilitation facility for 11 more days. Despite these efforts, the road to recovery is far from over when he finally returns home to Delaware.

During his recovery, he unfortunately slips and falls as he descends the last step at his home, leading to another hospitalization and long stay in a rehabilitation facility. His doctor discovers what appears to be a new fracture to the mid-shaft of the femur related to the motorcycle accident.

The motorcycle crash significantly impacts the retired Trooper's lifestyle. He walks with a permanent limp and struggles going up and down stairs. He has to give up his once favored hobby of motorcycle riding and now can only play nine holes of golf, a far cry from the eighteen he regularly played before the crash.

We are proud to secure a $544,872.50 settlement on behalf of the deserving client. No amount of money will restore him to his prior lifestyle but it’s at least some acknowledgment of the substantial injuries he suffered and continues to endure. $505,000.00 of the settlement is for his personal injuries which included money from his underinsured motorist carriers. Due to the potential for punitive damages and an excess verdict the insurer for the drunk driver paid $39,872.50 above the money it paid for his motorcycle exhausting the property damage limits in addition to its bodily injury liability limits.
